Intellectual Property & Content Notice Policy

OASES is published by ZEYO SASU, a French company registered in Paris under no. 830 635 512, Esc B 3ème étage, 2 Cité Noël, 22 rue Rambuteau, 75003 Paris, France (« ZEYO », « we »). We respect the intellectual property rights of others and expect our users to do the same. This Policy supplements Sections 11 bis and 13 of our Terms of Use.

1. Designated Copyright Agent (17 U.S.C. § 512(c)(2))

In accordance with the Digital Millennium Copyright Act (« DMCA »), ZEYO has designated the following agent to receive notifications of claimed copyright infringement, and has registered this designation with the U.S. Copyright Office (DMCA Designated Agent Directory):

2. DMCA Notification of Claimed Infringement (17 U.S.C. § 512(c)(3))

If you believe that content available on OASES infringes your copyright, send a written notification to our Designated Agent containing: (i) a physical or electronic signature of the copyright owner or of a person authorized to act on their behalf; (ii) identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are covered by a single notification); (iii) identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it (the exact OASES URL of each element, oasis or profile); (iv) your name, mailing address, telephone number and email address; (v) a statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; (vi) a statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf. Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages.

3. Our response

Upon receipt of a compliant notification we will act expeditiously to remove or disable access to the material (including any technical copies and thumbnails we hold), notify the user who posted it, and provide them with a copy of the notification. Our goal is to process complete copyright notifications within two (2) business days.

4. Counter-Notification (17 U.S.C. § 512(g))

If you believe your content was removed by mistake or misidentification, you may send a counter-notification to our Designated Agent containing: (i) your physical or electronic signature; (ii) identification of the material removed and the location at which it appeared before removal; (iii) a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification; (iv) your name, address and telephone number, and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which ZEYO may be found), and that you will accept service of process from the person who provided the original notification or their agent. Upon receipt of a valid counter-notification we will forward it to the original claimant; unless the claimant informs us within ten (10) business days that they have filed an action seeking a court order, we will restore the material between ten (10) and fourteen (14) business days after receipt of the counter-notification.

5. Repeat Infringer Policy (17 U.S.C. § 512(i))

ZEYO will, in appropriate circumstances, suspend and then terminate the accounts of users who are repeat infringers. As a rule, an account that is the subject of three (3) valid notifications within twelve (12) months is suspended, and terminated upon any further valid notification; serious violations may result in immediate termination. We keep a log of notifications and of the actions taken. ZEYO does not interfere with standard technical measures used by copyright owners to identify or protect their works.

6. Content imported from third-party services

OASES lets users save posts from third-party services (e.g. an Instagram Reel) into their own oases. At the user's request, a technical copy is stored for that user, with author attribution and a link to the original source (Terms of Use, Section 13.4). If you are the author or rights holder of imported content and want it removed from OASES, a notice under Section 2 is sufficient; we remove technical copies of imported content upon first request of the author or rights holder.

7. Other reports (EU Digital Services Act)

Reports of illegal content of any kind, trademark, privacy or publicity-right complaints, and communications from authorities may be sent to the same contact point, legal@oases.so, which is our single point of contact under Articles 11 and 12 of Regulation (EU) 2022/2065.
